1. Parties

These Terms and Conditions, and your acceptance thereof, form a contract between you (“you”) and Scottish Investment Trust and SIT Savings (together “the companies”).
The Scottish Investment Trust PLC (“Scottish Investment Trust”) is registered in Scotland with company number SC001651 and has its registered office at 6 Albyn Place, Edinburgh, EH2 4NL. It is an investment company within the meaning of section 833 of the Companies Act 2006.

SIT Savings Limited (“SIT Savings”) is registered in Scotland with company number SC091859 and has its registered office at 6 Albyn Place, Edinburgh, EH2 4NL. It is authorised and regulated by the Financial Conduct Authority (FCA), 25 The North Colonnade, Canary Wharf, London E14 5HS (FRN 125495).

2. Regulatory information

This website is intended for your personal, non-commercial use only, unless you and the companies have agreed otherwise in writing.

SIT Savings’ products are available to United Kingdom residents only and the information and products contained within this website should only be accessed by United Kingdom residents. 7.1     Nothing in these Terms and Conditions shall be deemed to limit the companies liability for:

(a)      death or personal injury caused by the companies negligence, or that of its directors, agents, officers or representatives;
(b)      fraud or fraudulent misrepresentation; or
(c)       any liability which cannot by law be restricted or limited.

If you are a business:

7.2      Subject to clause 7.1 above, the companies shall not be liable for the following types of loss or damage from claims arising out of or relating to this website, howsoever caused and whether such claims are based on negligence, breach of contract, strict liability, breach of statutory duty or otherwise:

(a)       loss of profits, business, contracts, revenue, goodwill or anticipated savings (whether such loss is   direct or indirect, foreseeable or otherwise); or
(b)       indirect or consequential loss.

7.3      Subject to clause 7.1 above, the companies shall not be liable for any loss or damage which may arise from or in connection with the use of or inability to use, interruption to, delay or the unavailability, operation or transmission of, this website, or from a computer virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this website or to your downloading of any content on it, or on any website linked to it.

7.4      The companies exclude all liability for any loss arising as a result of a cause which is beyond our control, including failure of electronic or mechanical equipment of any kind, failure of communication systems (including telephone, cable or internet), unauthorised access, theft, operator error or any other event of force majeure.
